Overview
A group of aquarium hobbyists who frequent the Internet Aquatic Plant Digest have been sued in Federal Court for $15,000,000 by Robert Novak d/b/a petswarehouse.com. The lawsuit was filed in the U.S. District Court for the Eastern District of New York. All of the defendants reside outside of New York. The lawsuit involves allegations of defamation for certain messages that were posted to the Aquatic Plant Digest.

As far as i'm concerned,why let these companies get away with ripping people off.These people that are being sued by Pet Warehouse,probably got a good cause to be pissed off,and i don't blame them one bit.I'm sure that 50% of the businesses on the internet don't give a **** about any of the people they sell there products to.once they get there ole mighty dollar there happy as pigs in ****.
I,myself just went throught the same ordeal.I would never buy from the scum bag again or would not recemmend his place to anyone.As far as i was concerned he was out to make his money off me and not give me service,that would keep me comming back to being a repeat customer.
Plus we all know that the customer,thats buying from these big companies,don't have a chance in hell fighting them in court.
Before i buy a large amount of items,or spend a large mount of money AGAIN from any online business,i will really check them out and ask tons of questions,from other consumers.
In other words i guess its BUYER BEWARE:thumbsup:

It really is too bad that PetsWareHouse.com took this approach, as I think that this will hurt them more than anything else.

Just to stir things up a bit and to offer an 'alternative view'..
I don't know anything about the above mentioned suit or claims from the thread authors either so I won't comment directly on this, just my general views on people that comment on vendors..
First off, to Pluff, your points are probably good ones, maybe valid ones, I don't know though, my eyes kept jumping to crap language and vague directions. Since this hobby is open to all ages and encouraged in younger ages, a responce like yours leads to giving forums a bad name. Will make people unclear of the facts begin to think the store is right and the forum authors are off the deep end. You don't take the appearance of forums to new heights by any means. When people have a point to make, they should do so carefully to maintain a professional image. If we (those that attend and use forums) look like pro's all the time, then the stores that are bunk will look substantially worse then they do.
Next to AJ, as a business owner, and an internet vendor at that, you should be aware of what damage one person can begin to inflict. I am almost certain that you have seen 'the' letter from someone regarding some company. Generally it is full of profanity, it is full of dead corals and it is full of tons of hate. More often then not, you can follow that persons threads back a few months, or even weeks and realise that the corals are dead because the person dropped $1K on clams and SPS etc in a tank they started 4 weeks ago after moving 'up' from a gold fish bowl. (I know, a little stretched but not too far off)..
There are often valid claims, but of those I have read and believed, they were carefully worded, accurate and gave specific details (like a 3" clam was only 1.3" and included a pic for proof).
If we are to 'attack' someone, I would hope we would do so in detail, accuratly and with the assumption that maybe, just maybe, we were the only one with this problem.
All I am saying is we need to continually prove that hobbiests are truly dedicated to our reefs and that when we believe a company is truly a scam we will go to great lengths to prove it, not just dump on them with profanity and accusations. As a vender AJ, I expect you pray that should you screw up, you would do so with a professional that will give you that chance too..
Again, I don't know the facts in the above case, I do know that being short on time and and being tired, I find myself doubting the validity of those being sued just from the above responses, sorry guys, my views, maybe only mine, but if we are going to sink someone lets do it right and lets keep this board and this hobby to all people, all ages and beginners to professionals!

The key here IMO and from what i understand is to state everything that can be considered an attack against someones business or name etc is to state that it is your opinion (IMO). If you don't state that its your opinion then you are stating a fact. Falsely stated facts can be sued over, opinions can't be as they are just that.. an opinion. Every one is entitled to their opinion no matter how outlandish it is.. freedom of speech.
Again this is only my understanding of the laws from what i have read, and i could be way off here.

Unfortunatly even clear opinions can be called in as defimation. There is a fine line between the 2 and including all facts allows the readers to act somewhat as a jury, but even then only one sided unless the other person has equal time.

when someting rong happend with a store the best ting to do first is to try to explane with him first if there no way of have arangement then you could post the fact and only the the fact and you dont need to slam or tell profanity and accusations.
then and only then the people will judje by there self
dont try to be the investigator,the judge and jurry
